Alec Baldwin had fired the shot that killed Halyna Hutchins while preparing for a scene at the Bonanza Creek Ranch church building near Santa Fe, New Mexico, USA. The gunsmith, Hannah Gutierrez Reed, had loaded the gun, who will also be charged with involuntary manslaughter following the shooting. The charges carry a mandatory minimum sentence of five years. Meanwhile, David Halls, who worked as an assistant director on the production, has also agreed to plead guilty to a charge of negligent use of a deadly weapon and serve six months of probation.

Mary Carmack-Altwies, who serves as the first judicial district attorney in Santa Fe, disclosed the charges in a statement Thursday. “After a thorough review of the evidence and laws of the state of New Mexico, I have determined that there is sufficient evidence to bring criminal charges against Alec Baldwin and other members of the ‘Rust’ film crew. Under my care, no one is above the law and everyone deserves justice.” Mary said while mentioning the allegations in her statement and on social media.

As reported by Variety, the special counsel appointed by Mary Carmack-Altwies, Andrea Reeb, to oversee the case said, “If any of these three people — Alec Baldwin, Hannah Gutierrez Reed or David Halls — had his job done, Halyna Hutchins would be alive today.” Meanwhile, Alec Baldwin has previously said the crew told him the gun was not loaded. His lawyer Luke Nikas said in a statement that his client had “no reason to believe that there was a live bullet in the gun” on the day the cameraman was killed, and subsequently condemned the charges leveled against the actor as ” a terrible miscarriage of justice’.
